DATE OF PROMOTION: On each day between July 16, 2007 and July 20, 2007, listeners of WTFM and viewers of WCYB may compete for a chance to participate in the “Last Pal Standing” money bag game to be held on July 21, 2007. Only one contestant will be selected to participate in the “Last Pal Standing” game.

ELIGIBILTY: This Promotion open to only legal residents who are 8 years of age or older. Void where prohibited or otherwise restricted. Employees, officers and directors of Pals, Fort Henry Mall, State of Franklin Savings Bank, WTFM, WCYB, and Creative Energy ("Sponsor"), its affiliates, subsidiaries, resellers, agents, and advertising and promotion agencies involved with this Promotion, as well as the immediate family members (defined as parents, spouse, children, siblings and grandparents) and those living in the same household of each such employee, officer and director are not eligible to enter. By participating, entrant agrees to abide by these Official Rules and by the decisions of Sponsor(s), which are final and binding in all respects.

HOW TO ENTER AND WIN: Official contest will begin on Monday, July 16TH and continue through Friday, July 20, 2006, where 98.5 WTFM and WCYB-TV will announce clues to find the “Golden Pal.” At the following times: On or around 6:45 AM (WTFM); on or around 6:50 AM (WCYB-TV); on or around 7:00 AM www.palstreasurequest.com, 11:50 AM (WTFM), on or around 12:10 PM (WCYB-TV); on or around 12:20 www.palstreasurequest.com, and 3:35 PM (WTFM); on or around 3:45 PM www.palstreasurequeset.com.   Clues will only be available by watching WCYB-TV or listening to 98.5 WTFM, or going to www.palstreasurequest.com at the times mentioned above. When the Golden Pal is found, the winner will be directed to produce evidence of the finding and once verified, that day’s game is over.  The winner of each day becomes a qualifier.   From the pool of the six (6) qualifying participants, one (1) and only one participant (“Contestant”) will be randomly selected to play the “Last Pal Standing” money bags game. The Contestant will be presented with exactly thirty (30) sealed money bag envelopes, from which the Contestant will be selecting one money bag at a time to be opened. Once a contestant has opened three (3) money bags containing amounts equal to any given prize amount listed below, that prize amount will no longer be available to be won by the Contestant. Contestant will continue to select and open money bags, one at a time, until such a time four of the five prize amounts have been eliminated as described herein. The remaining prize amount, i.e., the one prize amount for which the Contestant has not selected three matching money bags, shall be only prize amount for which the Contestant is eligible, subject to eligibility and verification. In the event that a Contestant is deemed ineligible or is otherwise disqualified, no alternate Contestant will be selected.

PRIZES AND ODDS OF WINNING:

• Grand Prize – 1 prize of $100,000 is available to be won. Odds of winning Grand Prize are 1:250.
• First Prize - 1 prize of $5,000 is available to be won. Odds of winning a First Prize are 1:71.43.
• Second Prize – 1 prize of $2,500 is available to be won. Odds of winning a Second Prize are 1:9.8.
• Third Prize – 1 prize of $1,000 is available to be won. Odds of winning a Third Prize are 1:4.17.
• Fourth Prize – 1 prize of $500 is available to be won. Odds of winning a Fourth Prize are 1:1.56.

The prizes must be accepted as awarded and cannot be substituted, refunded, or transferred. Limit one prize per person/per household.

Federal, State and local income taxes are the responsibility solely of the Prize Winners.
Awarding of prizes is subject to validation and eligibility verification. Final claim verification is subject to the validation by Sponsor and/or Sponsor’s promotion marketing agency. A potential winner may be required to provide Sponsor with proof that the potential winner is eligible for the Promotion prior to receipt of any prize. Unless otherwise prohibited by law, a potential winner shall be required to complete and submit paperwork provided by Sponsor, including a winner's affidavit and a liability/publicity release. The liability/publicity release shall grant permission to Sponsor, Administrator and their agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. Potential prize winner will have 10 days to return the winner’s affidavit from the date it was provided. If the potential prize winner to sign and return the affidavit of eligibility and liability/publicity release within the required time period, the prize will be forfeited. Unclaimed/Unawarded prizes will not be awarded.

DISCLAIMERS REGARDING PROMOTION
Promotion participants agree that neither Sponsor, prize providers, nor their respective direct and indirect parents, affiliates, subsidiaries, and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents ("Released Parties") will have any liability whatsoever for, and shall be indemnified and held harmless by participants from and against any breach of a representation and warranty, as well as any liability for any or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Promotion or Promotion-related activities. In the event Sponsor is prevented from continuing with the Promotion as contemplated herein by any event beyond its control, including, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which either Sponsor or prize providers at their individual sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, fire, flood, epidemic or other national health emergency, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared,) or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, public health crisis (e.g. SARS), or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to cancel, terminate, modify or suspend the Promotion or proceed with the Promotion in a manner deemed fair and appropriate. Sponsor reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of the Promotion for any reason as it relates to fraud or force majeure; or (2) to modify or change the Promotion, or any portion of the Promotion, and any applicable policies or terms or the official rules of this Promotion. IN NO EVENT WILL THE RELEASED PARTIES’ LIABILITY FOR ANY CAUSE WHATSOEVER WHETHER IN CONTRACT OR TORT EXCEED TEN DOLLARS ($10). CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Winner agrees to look solely to the Sponsor with respect to the Promotion and for any claims of any kind with respect to the Promotion or any such prizes. Except where prohibited, any and all disputes, claims and causes of action arising out of or connected with this offer or any Code shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Tennessee State Court located in Kingsport, TN, U.S.A.; any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys. fees; and, under no circumstances will there be awards for, and all participants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants or the Sponsor in connection with the offer, shall be governed by, and construed in accordance with, the laws of the State of Tennessee, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee.

Additional Rules

WCYB and WTFM and all sponsors reserve the right to refuse information over the phone in regards to broadcast clues.

All players/winners must be at least 8 years of age.

All players/winners under the age of 18 must have a signed parental consent to participate grand prize drawing.

Only one winner or qualifier per family or household will be allowed.

Winners must sign a release/hold harmless prior to receiving their prize.

The decision of all sponsoring parties is final.

Employees, their immediate family members or anyone living at the same address for the following sponsors are ineligible to enter/win/hunt:  98.5 WTFM-Holston Valley Broadcasting, Pals Sudden Service, Creative Energy, State of Franklin Savings Bank, Fort Henry Mall, and WCYB-TV.

Proper identification (valid driver’s license, passport, State ID, military ID) is required to receive prizes.

Additions or deletions of these rules may be made at the discretion of Creative Energy, and may be enacted at any time.

Pals Sudden Service, Fort Henry Mall, Creative Energy, 98.5 WTFM, State of Franklin Savings Bank and WCYB, its agencies, affiliates, sponsors or representatives absolve themselves of any liability, financial or otherwise resulting from any on or off-air contests staged by 98.5 WTFM or WCYB-TV.

All contestants acknowledge, as a condition of entry, that 98.5 WTFM Fort Henry Mall, WCYB-TV, State of Franklin Savings Bank, Pals Sudden Service, Kingsport Times News, and Creative Energy have the right to publicize, or broadcast the winner’s name, character likeness, voice or all matters incidental herein.

All prizes are non-transferable and void where prohibited by law.

Winners understand and agree that they are responsible for any and all taxes incurred on prizes received.

In the event that a winner chooses not to accept a prize, he or she forfeits all claim to that prize.  Sponsors then have the right, at its discretion, to award that prize to a contest runner-up.

Pals TreasureQuest Map Game

Additional Qualifier

No purchase necessary. To receive your free TreasureQuest map, come to any Pals locations.

Beginning July 15, 2007, participants may pick up their Pals TreasureQuest map at any Pals location.

On Tuesday, July 17, 2007, WCYB, WTFM, and palstreasurequest.com, will reveal where the golden pal was located.  The Kingsport Times will report the location in the next am edition (July 17, 2007), and will continue through the last clue date of July 20.  

Place a labeled, circled “x” in black or blue ink on each location where the golden pal was found.

On Saturday, July 21, 2007, maps will be collected from 12:00 pm – 4:30 pm at the Pals, 1735 Fort Henry Drive, Kingsport, TN  37663.  A tent sponsored by Pals and WTFM will be there as a collection point.

Maps must contain the name, address, age, telephone and/or work/cell phone numbers (limit 2) where an individual can be contacted at a moments notice.  Only one map per player will be accepted.

The additional qualifying map will be drawn at approximately 4:45 pm on Saturday, July 21, 2007, at the location designated above.

The random map drawn must have all the correct locations indicated with a labeled circled “x” in black or blue ink.   If the random map drawn does not have all the correct locations, it will be disqualified and another map will be drawn. 

Once the qualifying map is drawn, the individual will be contacted via telephone/cell phone number (limit 2) given on map.   One call will be placed to each number given.  In the event that we are unable to physically speak to the entrant, the map will be disqualified, and an additional map will be drawn.  Refer to above.

Rules Pals Treasure

Daily qualifiers will be asked to join sponsors on stage at J. Fred Johnson Stadium on Saturday, July 21, 2007.  Daily qualifiers are asked to arrive at or before 6:30pm at the Pals located at 1735 Fort Henry Drive, Kingsport, TN and will be given specific instructions as to which gate they should report to receive their credentials to enter the stadium.  Each qualifier will be allowed to bring one additional guest.  All additional guests must purchase a ticket to event to enter. 

Qualifiers will draw random numbers 1 through 6.  This number indicates the order in which the keys for the treasure chest will be drawn.  One of the six keys will open the treasure chest, which will contain $2,500.00 cash.  

The winner of the $2,500.00 would be encouraged to make a tax-deductible contribution of $1,000.00 to the charity of his or her choice.

The winner will then move to the next level to play Last Pal Standing envelope game.  See rules for Last Pal Standing Game.
